Terms of Service

Sfia Digital is a full-service digital agency based in Nairobi, Kenya, offering branding, content production, social media management, web development, digital marketing, animation, and related services (“Services”).

You agree to use this website only for lawful purposes. You must not:

• Use the website in any way that violates applicable Kenyan or international laws.
• Transmit any unsolicited or unauthorised advertising material.
• Attempt to gain unauthorised access to any part of the website or its systems.
• Reproduce, duplicate, or exploit any part of this website without our express written permission.

All service engagements between Sfia Digital and a client are governed by a separate written agreement or proposal that both parties have agreed to. In the event of any conflict between these Terms and a specific service agreement, the service agreement shall prevail.

Key principles that apply to all engagements unless otherwise agreed:

• Scope — work will be carried out as defined in the agreed proposal or brief.
• Payment — fees are due in accordance with the payment schedule in your agreement. Sfia Digital reserves the right to pause or withhold deliverables in the event of overdue payments.
• Revisions — a reasonable number of revisions are included as specified in the proposal. Additional revisions may attract further fees.
• Timelines — project timelines are estimates and depend on timely feedback and approvals from the client.

Upon receipt of full payment, all original creative work produced by Sfia Digital specifically for a client (including logos, website designs, and written content) transfers to the client unless otherwise stated in the service agreement.

Sfia Digital retains the right to display completed work in its portfolio, website, and marketing materials unless the client requests confidentiality in writing.

All website content, branding, and materials belonging to Sfia Digital — including this website — remain the intellectual property of Sfia Digital and may not be reproduced without written consent.

Clients engaging our services agree to:

• Provide accurate, complete, and timely information, materials, and approvals required to complete the work.
• Ensure that any content, images, or materials supplied to us do not infringe the intellectual property or other rights of any third party.
• Obtain all necessary licences and permissions for any third-party assets they wish to incorporate into deliverables.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of an engagement. This obligation does not apply to information that is publicly available or required to be disclosed by law.

To the fullest extent permitted by Kenyan law, Sfia Digital shall not be liable for any indirect, incidental, special, or consequential loss arising from use of our website or services, including but not limited to loss of revenue, data, or business opportunity.

Our total liability to any client in connection with a specific project shall not exceed the total fees paid by that client for the relevant project.

We may recommend or utilise third-party platforms, tools, or services (such as social media platforms, hosting providers, or payment processors) as part of delivering our services. We are not responsible for the performance, availability, or terms of such third-party services.

Either party may terminate a service engagement by providing written notice as specified in the relevant service agreement. Upon termination, the client shall pay for all work completed up to the termination date. Sfia Digital will deliver all completed work assets upon receipt of final payment.

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the Republic of Kenya. Both parties submit to the exclusive jurisdiction of the Kenyan courts for resolution of any disputes.

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our website or services after changes constitutes acceptance of the revised terms.
